These Terms of Service ("Terms") govern your access to and use of the Envios Digitales website and platform (the "Service") operated by Envios Digitales, LLC ("we", "us"). By creating an account or using the Service you agree to be bound by these Terms.
You must be at least 18 years old and able to enter into a binding contract. You are responsible for maintaining the confidentiality of your account credentials and for all activity that happens under your account.
Envios Digitales lets merchants automate the delivery of digital products (files, license keys, downloadable assets) to their customers after payment is confirmed. The Service is offered on a subscription basis under the plans published on our Pricing page.
You agree not to (a) use the Service to distribute unlawful, infringing or malicious content; (b) circumvent usage limits or security features; (c) resell or sublicense the Service without our written consent; (d) reverse-engineer or attempt to derive the source code of the Service.
You retain all rights to the files and materials you upload. By using the Service, you grant Envios Digitales a limited licence to host, transmit and deliver those materials to the recipients you specify. You represent that you have the necessary rights to distribute the content you upload.
Paid plans are billed in advance on a monthly or annual cycle. All fees are non-refundable except as required by law or as described in our Refund Policy. Failure to pay may result in suspension of the Service.
You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. We may suspend or terminate accounts that violate these Terms or that remain unpaid.
We target 99.98% monthly uptime and provide email and chat support on business days for all plans, with 24/7 priority support included on the Business plan.
The Service, including all software, logos and content we create, is owned by Envios Digitales, LLC and protected by U.S. and international law.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law.
To the fullest extent permitted by law, Envios Digitales, LLC will not be liable for indirect, incidental, special or consequential damages, or for lost profits or revenues. Our total liability under these Terms will not exceed the fees you paid to us in the 12 months preceding the claim.
You agree to indemnify and hold Envios Digitales harmless from any claim arising out of your use of the Service, your content, or your breach of these Terms.
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the state or federal courts located in Santa Clara County, California.
We may update these Terms from time to time. Material changes will be announced at least 30 days in advance. Continued use of the Service after the effective date constitutes acceptance.
